This act provides separate and enhanced penalties for persons who distribute fentanyl to minors. Any person who is at least age eighteen (18) and distributes fentanyl to a person under age eighteen (18) is guilty of a felony punishable by a fine specified in statute for certain controlled-substance offenses and imprisonment for up to twice the term authorized in W.S. 35-7-1031(a)(ii). The fine for this offense may be up to ten thousand dollars ($10,000.00), and the term of imprisonment may be up to twenty (20) years. The act defines "fentanyl" to include any isomer or other substance within the specific chemical designation of fentanyl.
